Abstract

This article examines the conduct of civil proceedings in higher courts, particularly appellate and cassation courts. It provides a comparative overview of procedures in developed countries and analyzes the legal framework and practice in the Republic of Azerbaijan. The paper discusses the significance of higher judicial instances in ensuring the correct application of law and the protection of individual rights. Special attention is paid to procedural guarantees, judicial discretion, and issues of accessibility and efficiency. The study concludes with findings on the effectiveness of the current system and offers recommendations for improvement.
